Oh God!!
How can we stop these EB2I - EB3I fights?
What unites us? Only in our fights for superiority?
I have no intension to fight. I am only asking for list of such Immigrants and made it big. It will be good talking points.

I think we should all post our unfortunate, painful stories to the newspapers and TV news channels.
We need to make ourselves herd. I don't think making some noise and gaining bit high profile will hurt us.
I have a collection of the emailid, let me know if this is fine with u guys, I will post it here.

I have observed that typically after becoming great, have a tendency to hide his/her EB3 roots. I mean, who'll hire you as a CEO or rocket scientist if they knew you used to be an EB3.
Obama's father was a Kenyan EB3, but Obama insists his father was an EB2. The labor certification that the white house has put out for Barack Obama is clearly a fake.
It's sad but true, America still judges you not by the content of your character but the color of your labor certification.
I propose that EB3s append "EB3" to their name (like Ganesh Teesravarg ME(Comp Sci.), EB3) so that they get more visibility, and ppl realize they live among us, and with some help can actually be productive members of society.
There are hundreds of eb3s including me, waiting for last several years, to do the work that all the other waiting eb3s would be proud of, but sadly enough, we have not yet got the greeeeeeeeeeeeeen caard :D

Will IV be trying to campaign/lobby against the 180 day delay?
90 days is a US law for every bill. Again, I don't see what IV has to do with that!
The other 90 days is because of amendment. Unfortunately this amendment was unanimously approved by the SJC. Can't see how IV can campaign against something like this too! And I think its prudent to wait 3 more months than rankle some lawmaker about this. We need publicity, but not negative publicity!
In any case, we will stick ONLY to our agenda.

I'm not sure of whether or not a company can file for your labor while you are on your EAD. Now i'm curious.
Please do post an update about this question and others in this thread once your attorney consult is done. Myself and other IVians would certainly appreciate it.
Thanks.
Logically it should not have any issues. If its EB2, the requirement is going to be different...means different job. So there is no issue.

Sanjay:
Most likely you will not have to do anything further and your application will be approved when the Visa Bulletin reaches your priority date. However it will depend on how long it is before that date is reached. you may have to be fingerprinted again, as the fingerprint checks are only valid for 18 months. Also, if the wait is long enough, USCIS may want you to go for another interview to make sure you are still eligible.
I heard contrary to what you mentioned about the fingerprints being valid only for 18 months. I think someone had posted a document from USCIS site that said that they have digitized FPs and can reuse them without having to do fingerprinting every 18 months. I will try to search for that document and will post if I find it

Thank you.. THis is very helpful.
You do not have to apply for new SSN but do the following taken from SSA website:
If your work eligibility has changed or if have become a U.S. citizen, you must apply for a replacement card. Your replacement card will no longer read Not Valid for Employment, but you will retain the same Social Security number.
To get a replacement card:
Complete an Application For A Social Security Card (Form SS-5); and
Show us documents proving your:
Immigration status;
Work eligibility; and
Identity.
Take (or mail) your completed application and documents to your local Social Security office.
All documents must be either originals or copies certified by the issuing agency. We cannot accept photocopies or notarized copies of documents.
We will mail your number and card as soon as we have all of your information and have verified your documents.
For details about the type of evidence you must provide, see Social Security Numbers For Noncitizens (Publication No. 05-10096) or Documents You Need for a Social Security Card.

Now that Shadegg's SKIL Bill has been referred to the Judiciary Committe...its in the hands of Sensenbrenner.
Shadegg is a top conservative and was supported by Sensenbrenner in his bid for Majority Leader earlier in the year. I found it interesting to read what he said about Shadegg earlier in the year, on the topic of immigration reform. Well, now is Sensenbrenner's chance to act upon it.

Sensenbrenner Supports Shadegg for House Majority Leader
(Washington, DC) Today, Congressman Jim Sensenbrenner (R-Menomonee Falls, WI), Chairman of the Committee on the Judiciary, announced that he is supporting John Shadegg (R-AZ) for Majority Leader.
Sensenbrenner said:
I have given careful thought over the past few weeks on the three exceptional candidates running for Majority Leader and what new direction the Republican Conference needs to go. I have decided to support John Shadegg for Majority Leader.
John Shadegg, as Chairman of the Republican Policy Committee, has shown leadership on difficult issues, while building a consensus among the Republican Conference. John is the best choice for Majority Leader. I have worked closely with John for many months now on immigration reform, attending numerous unity dinners that John has held, listening to members throughout the Conference. These proved to be a valuable resource and shows that John Shadegg is the person who can listen and lead us in a new direction.

Any answer to below question is appreciated.
Thanks,
I need advice..My project ended yesterday and I have another opportunity to work on EAD. I know my current employer will not be able to find a job for me as has been the case earlier and he will remove me from payroll soon. Can I start working with new employer and do not resign from my current employer?
I need help on this as I do not want to terminate my job from my side.
Any advice will be appreciated.

Question : If I get H1 transferred to NEWEMP (basically work on H1 and NOT EAD), and CURREMP revokes I-140, will this effect my GC process. I intend to work on H1 and keep on renewing EAD based on i-485 filed. NEWEMP will be providing AC21 letter which will be send to USCIS after I join them.
NO, I-485 filing > 180, also the I-140 is approved.
1. Will there be any effect to my GC process in case CURR Company revokes I-140?
No. if you send AC21 letter, you will not receive NOID (you might get RFE)
2. Can I keep on renewing EAD even though I would work on H1 with NewEMP?
Yes
Here is my thought -
If you are on H1B until Dec 2009, you will have to file H1B Extention for 7th Year (I am guessing you are in your second h1B renewal). For any reason if you get denial for I-485, your H1B extention will also be cancelled, remember extention was given to you on the basis of pending I-485 (GC).
so after DEC 2009 , it's the same wheather you are on EAD or H1B Extention.
Let say if you start using EAD now, you will have 1 yr 5 months left on your H1B. if there is something wrong with I-485, you can file H1B from different employer (this will not count against quota, as you have unsed 1 yr 5 month left on your H1B), go out of country and come back on H1B (you have more than 1 year left you can start another GC process :))
just my thought, you might want to validate this with any leagal expert.
Thank you Amit for your response.

Candidate should be physically present in USA, on the date of AP approval. Otherwise, that AP is not valid. When the candidate try to enter US, the IO will verify this information and may permit accordingly.
I-485 application considers abandoned, if a candidate leaves US without any valid Visa to re-enter. Remember, H1 / H4 cannot be stamped after I-485 approval.
I'm a layman like you, please consult an attorney.

Is there any clause that for AC-21 to be valid, a full time offer is required? The offer letters provided by companies like TekSystems are more contract based and you basically get paid/hour.

As part of this intiative, members who have gone through with service errors from USCIS can help and save others who might have to go through the same ordeal.
Please note, if you feel you have been a victim of USCIS service errors, sharing it here will enable IV to discuss these with USCIS and probably work on establishing a channel where USCIS can also help resolve applicants problems faster.
But the success of this initiative comes with how many of the past service errors we are able to collect.
So I hope members who have experienced a frustrating ordeal due to USCIS Service errors and had spent thousands of dollars for attorney fees to resolve those, can at least mention their ordeal here free of cost.
Every mention helps IV to get this initiative move forward.
